1.) Scope The following conditions apply to all nicola Kassat photography ( Nicola Kassat, Rhönstr. 9, 61381 Friedrichsdorf, hereinafter “Organizer”) of tenders, orders, services and deliveries. In the case of individual contractual provisions, these shall take place in accordance with these General Terms and Conditions.
By placing the customer’s order by the customer and accepting it by the organizer, a contract for the agreed services is concluded.
Deviating terms and conditions of the participant are hereby objected to as a precautionary measure. Deviating terms and conditions of the participant shall not be valid even if there is no express objection in individual cases, unless the organiser acknowledges them in full or in part in writing.
2.) Registration and payment A binding contract is concluded with the sending of the invoice data via e-mail. In order to register, the participant must pay the deposit within seven days of the week. Only then is the place considered to be firmly booked. Instalment payment is only possible by arrangement.
For short-term bookings less than 30 days before departure, the full amount of the invoice is due for payment immediately.
The course fees advertised at the respective course apply.
Food and drinks during the course are not part of the trip. When booking the additional package, the organiser provides drinks and packed lunches for workshops, coachings, as well as one-drink menus for evening events.
Arrival and overnight stay are included in the price, unless otherwise stated. For renewal nights, a separate contractual relationship must be entered into with the respective provider (hotel, restaurants, etc.). The appointment also takes place in bad weather.
3.) Cancellation If the workshop or coaching is cancelled by the participant, the amount will not be refunded. However, the participant has the possibility to assign his/her place to another person. In this case, the full course price will be refunded and charged to the new participant.
The organizer is entitled to postpone the appointment due to illness or due to force majeure. The course fees already paid will be converted into a voucher and entitle you to participate in an alternative date. A claim for damages by the participant (e..B. reimbursement of travel and pension costs) is excluded.
4.) Rights of use The image material created during a workshop or coaching may not be used commercially.
The resulting photos may be used and published privately, as well as serve as a public extension of the portfolio.
All rights to the seminar documents are with the organizer. Copying, distributing and publishing the documents is not permitted.
5.) Liability Participation in the workshops or coachings is at your own risk. The organizer is not liable for theft, damage to participants, material, equipment, as well as lost personal belongings of the participant during the event. In the event of an accident during arrival and departure, each participant is liable himself.
If the participant cancels due to physical discomfort or illness during the event, the course fee cannot be refunded.
Anyone who intentionally or through gross negligence violates his obligations as a participant may be excluded from further participation in whole or in part. A refund of the course fee is excluded in this case. The participant shall compensate the organizer for any damage caused.
7.) Privacy The Promoter processes personal data in compliance with the applicable data protection regulations. The data (e.B. name, address, e-mail address or telephone number) are collected, processed and used by the organiser in the automated process to the extent necessary for the establishment, design or modification of the contractual relationship.
The organiser is entitled to transmit this data to commissioned third parties – e.B. but not limited to tax advisors, lawyers or debt collection service providers, insofar as this is necessary in order to fulfil the concluded contracts. If this is necessary for the clarification or fulfilment of the contract concluded here, the participant agrees that they may contact the participant by e-mail and/or telephone.
As long as the participant does not object, the organizer is also entitled to collect, process and use the data received for the consultation of the participant, for advertising, for market research for the company’s own purposes and for the needs-based design of our offer. This consent can be revoked by the participant at any time without giving reasons. For this purpose, a simple e-mail to info@nikafotos.com
8.) General ancillary agreements to the contract or to these GTC require written form in order to be effective.
The possible nullity or ineffectiveness of one or more provisions of these GtC shall not affect the validity of the remaining provisions. The parties undertake to replace the invalid provision with a meaningful effective provision that comes closest economically and legally to the intended regulation.
9) Applicable law The contract concluded between the promoter and the participant is governed by German law to the exclusion of the conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection law remains unaffected.
